Committing to a charter booking or using our Service means you accept these Terms. Access to the Service is not permitted for those not agreeing with any section of these terms.
2. Service Overview
GlassHouseGaze is dedicated to providing superior yacht charter services such as:
- Yacht rentals for the day
- Evening boat tours
- Business getaways
- Exclusive gatherings
- Charters spanning multiple days
Service availability is contingent on weather and may change. We have the authority to alter or discontinue our services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Booking prerequisites include:
- Minimum age of 18 years
- Provision of accurate, complete information
- Advance payment as outlined in your reservation confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed only after we receive the respective payment and send a written confirmation. Reservation acceptance is at our sole discretion.
3.3 Availability
Charters depend on the availability of vessels and appropriate weather conditions. We strive to accommodate your preferred dates and times to the best of our abilities.
4. Payment Terms
4.1 Pricing
All prices are in € and are inclusive of taxes, except where indicated otherwise. Prices may vary and can be changed without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter price required at the time of reservation
- Remaining balance: Due 48 hours ahead of the charter's commencement
- Incidental expenses (if applicable): To be paid upon the charter's completion
4.3 Payment Methods
We accept primary credit cards, electronic funds transfers, and certified cheques. Payment operations are safeguarded through secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus any processing fees
- 24-72 hours before departure: 50% of the total amount refunded
- Less than 24 hours before departure: No refund is issued
5.2 Weather Cancellations
If our captain deems weather conditions to be unsafe, options will include:
- Rescheduling to another available time at no additional cost
- A complete refund if rescheduling is not an option
5.3 Mechanical Issues
Should there be mechanical difficulties with the vessel allocated, efforts will be made to provide an equivalent alternative. If that's not possible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
It is mandatory for all passengers to:
- Heed all instructions from the crew
- Utilize provided safety apparatus when needed
- Disclose any health issues that could impair their safety
- Stay within approved areas on the yacht
6.2 Prohibited Items
The following are not allowed on board:
- Containers made of glass
- Unlawful materials
- Weapons or firearms
- Non-alcoholic beverages if in excess
- Pets (except with prior permission)
6.3 Conduct
Passengers are expected to behave respectfully. We have the right to terminate a charter early without a refund if the conduct of passengers presents a threat to safety or disturbs other clients.
7. Liability and Insurance
7.1 Our Liability
Our liability is restricted to the payment made for your charter. We assume no responsibility for:
- Injuries resulting from passenger recklessness
- Loss or damage to personal items
- Indirect, consequential, or exemplary damages
- Delays due to weather or events beyond our control
7.2 Insurance Coverage
Our operations and vessels are covered by comprehensive maritime insurance. Passengers are accountable for their own personal and travel insurance.
7.3 Assumption of Risk
Participating in our charters implies an understanding that maritime activities carry inherent risks, and you accept responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We have the authority to adjust itineraries, paths or schedules due to weather, safety, or operational demands. We will endeavor to provide alternatives of comparable value.
9. Force Majeure
We are not accountable for changes, postponements, or cancellations steered by events beyond our control, which include but are not restricted to:
- Extreme weather
- Natural calamities
- Governmental decrees
- Harbor closures
- Vehicular malfunctions
10. Privacy and Data Protection
We handle personal details in line with our Privacy Policy. Utilizing our services constitutes consent to the collection and usage of information as stated.
11. Intellectual Property
The content on our site, including texts, images, and logos, is intellectual property protected by copyright and trademark legislation. Unauthorized reproduction or distribution is prohibited without prior consent.
12. Governing Law
These Terms are structured under the laws of Germany. Any related disputes will be adjudicated in the legal courts of Hamburg, Germany.
